Common Case Types
Divorce Basics
Contested versus uncontested divorce and the steps involved.
Uncontested and contested
In an uncontested divorce both spouses agree on everything (property, debts, support, parenting) and the process can be mostly paperwork. A contested divorce involves disputes the judge must decide.
Typical steps
- File a complaint or petition and serve your spouse.
- Exchange financial disclosures.
- Negotiate or mediate.
- Attend hearings, and a trial if needed.
- Receive a final judgment.
Most states have waiting periods and residency requirements. Courts publish forms for uncontested cases.
