Common Case Types
Getting a Security Deposit Back
How long a landlord has to return a deposit, what they may deduct, and how to claim it in small claims.
The rules
Most states require landlords to return a deposit, minus itemized deductions for unpaid rent or damage beyond normal wear and tear, within a fixed number of days after move-out. Some states penalize landlords who miss the deadline or don't itemize, sometimes with double or triple damages.
Building your claim
- Your lease and proof of the deposit paid
- Move-in and move-out photos or video, dated
- Your forwarding address, given in writing
- Any itemized list the landlord sent
Steps
- Send a written demand letter citing the deadline.
- If there's no response, file in small claims.
