Your options
- File a wage claim with your state labor department, often free.
- File with the U.S. Department of Labor's Wage and Hour Division for federal minimum wage and overtime.
- Sue in small claims or civil court.
Evidence
Pay stubs, schedules, timesheets, texts about hours, your own dated record of hours worked, and any offer letter.
Deadlines
The federal Fair Labor Standards Act generally allows two years, or three for willful violations. State deadlines differ.
